4. Use of the Website
(1) Use of the Website is generally possible without registration.
(2) Certain functions (e.g. customer account, license management, downloads) require registration.
(3) Users agree not to misuse the Website, in particular not to:

5. User Account

6. Conclusion of Contract in the Online Shop
(1) The presentation of products in the Shop does not constitute a legally binding offer but an invitation to place an order.
(2) A contract is concluded once the provider confirms the order by email or grants access to the download.
(3) The contract language is German.
7. Digital Products and Downloads
(1) The products offered are primarily digital content (e.g. software, plugins, license keys).
(2) Digital products are made available for download or via the customer account after receipt of payment.
(3) Separate plugin license terms and conditions apply to software products.
8. Prices and Payment
(1) All prices are stated in euros and include statutory VAT unless otherwise indicated.
(2) Payment is processed via the available payment service providers (e.g. PayPal, Mollie).
(3) The provider reserves the right to exclude certain payment methods.
9. Right of Withdrawal for Digital Content
(1) Consumers generally have a statutory right of withdrawal.
(2) For digital content, the right of withdrawal expires once:

the user has expressly agreed that performance begins before the withdrawal period expires, and

the user has acknowledged that this results in the loss of the right of withdrawal.
(3) Corresponding information is provided during the ordering process.
10. Liability
(1) The provider shall be liable without limitation in cases of intent and gross negligence.
(2) In cases of slight negligence, the provider shall only be liable for breaches of essential contractual obligations and limited to foreseeable damages.
(3) In particular, no liability is assumed for:

incompatibilities with third-party software,

legal consequences arising from improper use of the content.
11. Availability of the Website
The provider does not guarantee uninterrupted availability of the Website or individual functions.

Terms of Use for MH-Accessibility Pro
1. General

These Terms of Use apply to the use of the MH-Accessibility Pro plugin (hereinafter “Plugin”) provided by Rüdiger Zirks Webdevelopment / MH-Accessibility, Max-Herz-Ring 112, 22159 Hamburg, Germany.

By purchasing or installing the Plugin, you agree to be bound by these Terms of Use.

The Plugin is licensed to you under these terms; it is not sold.
2. License Grant

The licensee is granted a non-exclusive, non-transferable right to use the Plugin for the agreed number of installations.

Each license may be installed and activated on only one website, unless a multi-license package has been purchased.

The Plugin may not be resold, rented, or transferred to third parties without the express consent of MH-Accessibility, except as allowed under the B2B/Agency regulations (see Section 4).
3. Restrictions on Use

The Plugin may not be modified, reverse-engineered, decompiled, or disassembled.

The license does not permit the use of the source code for creating your own software or competing products.

Any use beyond the agreed license count or without a valid license key constitutes a violation of these Terms of Use.
4. B2B / Agency Regulations

Agencies and commercial resellers may purchase a license package that contains a specific number of license keys.

Each license key may be activated exactly once on a client’s website.

The total number of simultaneously used licenses must not exceed the number purchased in the package.

The agency is responsible for ensuring that the license terms are complied with on the client’s websites. Any use without a valid license key is not permitted.

License keys may not be distributed to third parties outside of client projects.
5. Support and Updates

MH-Accessibility Pro provides technical support and updates as part of the license, subject to the terms of the purchase or license package.

The right to updates may be limited in time or version, according to the terms of the purchased package.
6. Liability

Use of the Plugin is at your own risk.

MH-Accessibility assumes no liability for any damages, direct or indirect, arising from the use or inability to use the Plugin, to the extent permitted by law.

For damages caused by intentional or grossly negligent actions by MH-Accessibility, liability is governed by statutory provisions.
7. Term and Termination

The license becomes effective upon payment and provision of the license key.

The license is perpetual, but may be terminated by MH-Accessibility in the event of any violation of these Terms of Use.

Upon termination, the Plugin must be removed from all websites on which it is installed.
8. Changes to Terms of Use
MH-Accessibility reserves the right to modify these Terms of Use at any time. Changes will be communicated to the licensee in an appropriate manner.
9. Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Should any provision of these Terms of Use be invalid, the remaining provisions remain in full force and effect.

The place of jurisdiction is Hamburg, Germany, to the extent legally permissible.
